TagSentry is a product of Orbit Metrics Inc., 1776 N Scottsdale Rd #1182, Scottsdale, AZ 85252, USA ("TagSentry", "we", "us").
These terms are the agreement between you and TagSentry when you use our service. We've kept them short. By creating an account, you agree to them.
The service
TagSentry provides a consent banner, consent records, event monitoring and related tools for websites, through our dashboard, our API and the code you add to your site. We'll keep improving it, which means features can change. We won't take away something you're paying for in the middle of a billing period without telling you.
Your account
You're responsible for your account and for what happens in it, including anyone you invite. Keep your sign-in details and API keys safe, and tell us straight away if you think someone else has them.
You may only add websites you own or are authorised to manage.
Your responsibilities
TagSentry helps you ask for consent and keep records, but you are responsible for your own compliance with the laws that apply to your website. We apply the rules each region publishes and tell you what we decided for each tracker, but we don't give legal advice. Check your setup with your own adviser if you need certainty.
You must follow our acceptable use policy.
Paying
Each site is free until it passes a free allowance. Then it's charged monthly at the level its usage has reached, at the prices on our pricing page. A site moves up a level automatically as it grows and stays there until you choose to lower it. We email you each time a site moves up. If you have a card on file, a site moves to a paid plan automatically when it passes an allowance, unless you turn that off. Fees are charged in US dollars and don't include taxes unless we say so.
Billing never switches off your banner. If a payment fails, consent keeps working. After 7 days unpaid the site returns to Free, where event monitoring pauses once past its free allowance. ## Our guarantee
Painless, or it's free. If setting TagSentry up isn't the easiest thing you do that week, tell us within your first 30 days on a paid plan. We'll fix it with you, or refund what you paid for that period.
Cancelling
You can move a site back to Free or remove a site at any time from the dashboard. To close your account, choose "Close this business" in Settings, and within 30 days we delete it and its data, consent records included. A locked audit copy of consent records stays until its 24 months are up, then it's deleted. Remove our code from your site to stop the banner.
We may suspend or close an account that breaks these terms or the acceptable use policy, or doesn't pay. Where we can, we'll warn you first.
Your data
Your data is yours. We handle it as described in our privacy policy and, for your visitors' data, our data processing agreement.
The limits of our responsibility
We work hard to keep TagSentry running and correct, but we provide it "as is". To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability to you is limited to what you paid us in the 12 months before the claim.
Changes to these terms
If we change these terms in a way that matters, we'll email account owners at least 30 days before the change takes effect.
Governing law
These terms are governed by the laws of the State of Arizona, USA. Any dispute goes to the state or federal courts in Maricopa County, Arizona, unless the law where you live gives you the right to bring it somewhere else.
